The statement that "there can be no 'agreement' between third parties; these agreements are simply 'contracts'" is nonsense. First, any parties can have an agreement. Second, the very definition of "contract" is an agreement between two or more parties.
Although this sentence as given is clearly wrong, I have not stricken or rewritten it because I don't know the author's intention. Perhaps there is a valid point about SLA's that the author was trying to make, but phrased it wrong.
