Fair use rationale for File:Besnard-Lakes Blog 5001 s.jpg[edit]

I notice the file page specifies that the file is being used under fair use but there is not a suitable explanation or rationale as to why each specific use in Wikipedia constitutes fair use. Please go to the file description page and edit it to include a fair use rationale.

The Besnard Lakes image[edit]

Thanks for uploading and adding the File:Besnard-Lakes Blog 5001 s.jpg‎ to the band's article! Unfortunately, the image cannot be used with the fair use claim – it is acceptable only in cases where no free images could exist, i.e. when a band has split. So under present conditions the images will be deleted. However, as you claim to "handle [The Besnard Lakes'] web presence" you might want to consider releasing the image under a free license, if that is possible. Hello, In reference to your comment regarding me posting the besnard lakes picture, I was told by the band and their label that it was ok to use the picture on wikipedia. This is a press picture and was available for posting on blogs, website, magazines etc... I'm very confused about your picture licensing policies. Can you recommend the best course of action ? If I put it up under a free license, what does that really entail ?

Wikipedia requires that the copyright holder of the image (usually the original author) releases the image with explicit information on licensing. That is, simply making the image available on the net for anyone to use but without any licensing information is, unfortunately, not enough. Wikipedia also does not accept licensing that gives the permission to use the image only to Wikipedia exclusively; a free license is required. Putting an image up with a free license means that you (irrevocably) allow anyone to reuse the image, make derivative works of it, etc. Wikipedia also requires that the images can be reused in commercial contexts as well. For examples of free licenses see Wikipedia:File copyright tags/Free licenses; the most common license of choice on Wikipedia is CC-BY-SA+GFDL. Please bear in mind though, that when you add a license to the image in question, it must also be accepted by the copyright holder (whose rights are being released in the process). OK. I'm going to check with the label and the band about that. Meanwhile, is it possible you think to take the current picture down? The band really does not like the way it represents them and I thought it would be possible for it to be taken down/deleted on that basis. Please let me know.

Besnard Lakes[edit]

Hi there, thanks for the message - I replied on the talk page of the article. My view is: go ahead, be bold; the more images the article has, the better! I just don't think that that heavily edited press shot was appropriate, when we had a properly licensed photo of the band in action. If you have better pics, that's great. I'm not, but the man in question uploaded the pic himself to wikicommons (since he owns the rights for it). I just have the privilege to be his brand new web wizard :) but I have to say, this is the first time I deal with wikipedia, I wasn't sure how to handle the rights. I'm glad it all worked out in the end.

Yup, it's a great pic too. I know managing the rights to pictures and stuff is a bit of a pain, but I'm sure you understand why and, as you say, it's all worked out nicely now. I met Jace at a show in Nottingham, England a few years ago and he seemed like a cool guy - the band were awesome that night, too. Just one last thing: in the infobox for the band, you can give the image a caption - would be good to have some kind of 'left to right' of who's who in the pic (I only know which one is Jace and which one is Olga!).
