Sentence not supported by source

Sentence: As he had not yet served the mandatory military duty of two years in the Kingdom of Bavaria, this emigration was illegal.

Source: "escaping three years of compulsory German military service. It might have been illegal, but America didn’t care..." 1) It (the part that MIGHT HAVE BEEN illegal)seems to refer to escaping three years of "compulsory German military service", not the emigration. 2) The source says 3 years, but the Wikipedia article says 2 years 3) Changing "might have been" to "was" is unsupported by this source
