Assuming the photo was taken in 1874, it is not impossible for the photographer to have still been alive by 1911, and thus the "author has been dead +100 years" term might not apply. It is exceedingly improbable, however, that the photographer would have still been alive by 1941, and thus the "author has been dead +70 years" license has been selected.
