It is disputed whether this file violates our non-free content criteria. The reason given is: A free image cannot be found. While the band was active, they were notoriously camera-shy. Flash photography was banned at their gigs. And the band is no longer active, so a free image cannot be reasonably expected to be created at this point. Disputed fair use claim [Sept. 2015][edit]

Hi @Stefan4: and @J Milburn: I noticed your respective ShadowsCommons tagging and Delete Request regarding this image. I'm afraid the band's article is outdated. They are not currently active, as they haven't performed publicly since November 23, 2013, and haven't released anything since their 2014 Record Store Day single "I'm Less Here". Plus, I don't particularly believe that this qualifies as an acceptable substitute. The image is poorly lit (as the uploader describes), David Roback's face is obstructed by several microphones/a drink, and the rest of the band is blurred beyond recognition (you'd swear Colm Ó Cíosóig was John Lennon). Do as you wish, but I'll try to find a better CC image elsewhere over the next couple of days. Homeostasis07 (talk) 23:25, 24 September 2015 (UTC)[reply]

The file on Commons appears to show the same band and is freely licensed, so that image is an acceptable replacement for this one. --Stefan2 (talk) 10:27, 25 September 2015 (UTC)[reply]

The image is not used in the article about David Roback but in the article about a band. The image therefore only needs to identify the band but not necessarily David Roback. The question on whether the image identifies David Roback or not is therefore irrelevant. --Stefan2 (talk) 13:08, 26 September 2015 (UTC)[reply]
Head, meet brick wall. David Roback is the chief musical songwriter of the band, hence a major part of the band. The image obscures David's face, and is of inadequate quality to properly act as the primary means of visual identification for the band's article.
