In the court case the article is about (448 F.3d 605; 2nd Cir., 2006), the fair use of this and several other unlicensed images of posters owned by the Bill Graham Archives promoting Dead shows in a coffee-table history of the band was at issue. In a footnote (610n3) Judge Jane Restani noted how this image specifically enhanced understanding of the accompanying text describing a controversy between the band and Radio City Music Hall's management over the use of the skeletons that led to litigation and the purported destruction of most of the posters produced; this is discussed in a paragraph in the article. The use of this image enhances the reader's understanding of the enhancement of the reader's understanding as well as the reader's understanding of fair use. (The use described by Restani is also, perhaps not coincidentally, consistent with our own fair-use policy, particularly FUC #8.)

Any derivative work based upon the artwork would be a copyright violation, so creation of a free image is not possible.
Minimal use (WP:NFCC#3) It has been reduced to 300px in width from what it was at the Bahr Gallery page (which was itself a considerable reduction from the original work). The Bill Graham Archives decision that this image is being used in, in fact, holds that the reduction in size of the image greatly assists the fair use claim as it is unlikely that any collector or buyer of these posters would be interested in paying for such a small copy.
