Fair use rationale in Davison's[edit]

It is contended that the use of this image qualifies as fair use when used in the article on Davison's for the following reasons.

  1. This image is copyrighted and there is no non-copyrighted version of this image available.
  2. This image is used for identification and or educational purposes only in the article on Davison's, and other articles if specific fair use rationale can be provided.
  3. This image enhances the article in which it's displayed, as it provides an immediate relevance to the reader more capably than the textual description alone.
  4. This image is of a reasonably low resolution.
  5. This image does not limit the copyright holder's ability to profit from the original source, nor will it dilute the importance or recognition of the logo in connection with its organization.
  6. This image is not replaceable; logos are always presumed non-free per WP:LOGO.

my fair use rationale is simple. While Macy's continues to hold the name of its former stores as TradeMark, it has not from my trade mark research continuded to uphold the logo's.

Trade Marks generally only last a certain period of time. If they are not maintained, they can be purchased.

My fair use is that this logo dates from the 1970s. It has not appeared in print, TV, or signage since 1985. Its a fair use. If this is disallowed, all logo's of active stores will have to be disallowed.Etittle1978 03:44, 3 June 2007 (UTC)
